These Terms of Use ("Terms") govern your use of the Pero mobile application, the website at peroday.app and the backend service behind them (together, the "Service"). The Service is operated by Oleh Chausov, an individual developer residing in Kharkiv, Ukraine ("Pero", "we", "us").
By creating an account or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service. Questions: support@pero.day.
1.1. You must be at least 13 years old, or older if your country sets a higher minimum age for services like this. If you are under the age of majority where you live, you may use Pero only with a parent's or guardian's permission.
1.2. You confirm that you are able to enter into a binding agreement.
2.1. Pero is a voice-first task manager. You speak, a speech-to-text model transcribes it, a language model sorts it into a task, note or quick win and fills in properties, and Pero assembles a daily plan of one big, three medium and five small tasks. You can also type tasks and notes, organise them into projects and goals, ask Pero questions about your own tasks, and receive a daily reminder and a weekly review.
Transcripts and triage results can be wrong, incomplete or misattributed. Pero marks its guesses and lets you correct them, but you are responsible for checking what ends up in your plan before you rely on it.
2.3. Not a professional or emergency service. Pero is a planning tool. It does not provide medical, psychological, legal, financial or crisis help. If you are in an emergency or thinking about harming yourself, contact your local emergency number or a crisis line.
2.4. Internet required for capture. Reading and editing existing tasks works offline and syncs later. Voice capture, triage, questions and plan assembly need an internet connection and our backend.
3.1. On first launch Pero creates an anonymous account on your device. You may later sign in with Apple or Google to keep your data across devices and reinstalls. Anonymous accounts that stay inactive for 30 days are deleted automatically (see the Privacy Policy) unless they hold a subscription.
3.2. You are responsible for what happens under your account and for keeping your device and sign-in method secure. Tell us at support@pero.day if you suspect unauthorised use.
3.3. One person, one account. Do not use another person's account.
4.1. Pero offers a free tier with usage limits and a paid Pro subscription that raises those limits and unlocks additional features. The current products, prices and any free trial are shown in the app at the time of purchase and may change.
4.2. Subscriptions are sold through the Apple App Store and are subject to Apple's terms. Apple charges your Apple ID account at purchase confirmation.
4.3. Auto-renewal. A subscription renews automatically for the same period (weekly, monthly or yearly as chosen) at the price shown at purchase, unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the current period ends.
4.4. Managing and cancelling. Manage or cancel your subscription in your Apple ID account settings (Settings, then your name, then Subscriptions). Deleting the app or your Pero account does not cancel the subscription. Cancellation takes effect at the end of the paid period; there is no partial refund for the remaining time.
4.5. Free trials. If a trial is offered, any unused part of it is forfeited when you buy a subscription. Unless you cancel at least 24 hours before the trial ends, the paid subscription starts automatically.
4.6. Price changes. If we change the price of a subscription, Apple will notify you in advance and, where required, ask for your consent before the new price applies.
4.7. Refunds. Refunds are handled by Apple under its policies, not by us. Request one at reportaproblem.apple.com. Except where the law or Apple's policies require otherwise, payments are non-refundable.
4.8. Apple standard EULA. Unless a custom licence agreement is shown on the App Store page, Apple's Licensed Application End User License Agreement applies to the app. Where it conflicts with these Terms, the Apple agreement prevails for the matters it covers.
5.1. The free tier and Pro both carry daily quotas on captures, questions and other AI-backed operations, plus rate limits to protect the backend. Quotas are shown in the app when you reach them.
5.2. We may adjust quotas and limits to keep the Service healthy. We will not reduce what a paid subscriber has already been billed for without notice.
6.1. You own the tasks, notes, goals, projects and recordings you put into Pero ("Your Content").
6.2. You grant us a non-exclusive, worldwide, royalty-free licence to store, copy, transmit and process Your Content only as needed to run the Service for you. This includes sending audio to a speech-to-text provider and sending transcripts and task text to the language-model providers named in the Privacy Policy. AI processing is enabled when you pass the microphone step of onboarding; the Privacy Policy explains how to stop it.
6.3. We do not use Your Content to train AI models, do not sell it, and do not show it to other users.
6.4. You are responsible for Your Content. Do not put into Pero anything you have no right to hold, or anything unlawful.
You agree not to:
8.1. The app, backend, design, brand "Pero" and the raccoon and quill artwork are ours and protected by copyright and trademark law.
8.2. We grant you a personal, non-transferable, revocable licence to install and use the app on Apple devices you own or control, for your own non-commercial use, subject to these Terms and Apple's usage rules.
9.1. We may change, add or remove features, and may suspend the Service for maintenance. We try to give notice of material changes in the app.
9.2. The Service depends on third-party providers (hosting, AI models, app stores). We are not responsible for outages on their side but will work to restore the Service.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT TRANSCRIPTS, TRIAGE OR PLANS WILL BE ACCURATE.
Consumers in some countries, including the EEA and the UK, have statutory rights that this section does not limit.
TO THE EXTENT THE LAW ALLOWS, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST DATA, PROFITS OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE.
Nothing in these Terms limits liability for death, personal injury, fraud, or anything else that cannot be limited under applicable law.
To the extent the law allows, you will compensate us for claims and costs arising from your breach of these Terms or your unlawful use of the Service.
13.1. You can stop using Pero at any time and delete your account in Settings, then Account, then Delete account.
13.2. We may suspend or close your account if you breach these Terms, if the law requires it, or if we discontinue the Service. Where reasonable we will warn you first.
13.3. Sections 6.3, 8, 10, 11, 12 and 15 survive termination.
We may update these Terms. We will change the effective date above and, for material changes, notify you in the app. Continuing to use Pero after the change takes effect means you accept the new Terms. If you do not agree, stop using the Service and delete your account.
These Terms are governed by the laws of Ukraine. Disputes go to the competent courts of Ukraine, unless mandatory consumer-protection law in your country of residence (including the EEA, the UK and California) gives you the right to a different forum or stronger protections, which these Terms do not take away.
Apple is not a party to these Terms and is not responsible for the app or its content, but Apple and its subsidiaries are third-party beneficiaries of Section 8.2 and may enforce it against you.
